Important OLT Decision to Block Development of a "Natural State" Lot

On June 29, 2022, the Eastern Georgian Bay Protective Society (EGBPS) and the Township of Georgian Bay (TGB) won an important environmental victory at the Ontario Land Tribunal (OLT) preventing the development of Georgian Bay shoreline in a critical type one fish habitat. At issue was the refusal of a zoning by-law amendment for a cottage and dock build on Mermaid Island near Honey Harbour.

GBA has provided support over the last couple of years for the EGBPS and Township of Georgian Bay in protecting significant wildlife and fish habitat from development at this location. The Moreau property owner on Mermaid Island has been trying to get the H2 hold on this small lot lifted to permit development, despite the clear evidence that only a very long dock would provide access, which would greatly disturb the highly sensitive fish habitat.

This decision is significant because it will provide a major disincentive for approximately 30 other similar “natural state” properties in the Township of Georgian Bay that are also looking to develop. Zoning and holds on all these properties are there for a reason – important habitat must be protected from development.
